Just making sure we are all on the same page.

Waiver of Liability and Indemnification

The Applicant accepts that sailing, and participation in these Programs, are subject to certain inherent risks, both known and unknowable, on land and on the water, and by registering for Program the Applicant accepts those risks and hereby agreeing as follows:  

To the extent permitted by applicable law, the Applicant voluntarily consents to the their participation in the Program as offered by Black Rock Sailing School (BRSS) and in consideration of the Applicant’s participation in the Program, waives any claims against, releases any obligation of, and indemnifies BRSS, and all of their respective members, officers, directors, employees and agents, (each an “Indemnified Person”), from and against any and all claims for: i) personal or bodily injury, or loss or damage of property of the Applicant; ii) negligence or other error or omission as part of any emergency response that may be provided by BRSS as part of the Program; and/or iii) reasonable attorney’s fees that may be incurred by BRSS in responding to or enforcing this provision as a result of a claim.

Emergency Medical Response

In addition to immediate emergency response, the Applicant hereby authorizes an instructor from the Program, or BRSS, to authorize emergency treatment if the emergency contact cannot be reached at the time of the emergency.   

Photo / Video release

The Applicant agrees to allow photos or video of themselves taken during the Program to be used in advertising and social media related to the Program and/or other BRSS use.

PFD

The Applicant understands and agrees that they MUST always wear a suitable Personal Flotation Device when requested by a BRSS instructor or employee.

Minimum enrollment policy

At least two people are required to run an ASA 101, 103, 104, or 106 and four people are needed to run an ASA 105 certification course so BRSS may choose to cancel a course if this minimum is not met. If by one (1) week prior to the course the minimum is not met the course may be rescheduled. While rescheduling is unlikely, please have alternative dates avaialable.

Electronic Signature

Please read the registration and waivers. They include release of liability and waiver of legal rights and seek indemnification for certain claims.

By signing up electronically and paying for the program, the applicant acknowledge that they have both read and understood all text presented as part of the registration process and agree to the waiver and related terms of Registration.

Cancellation policy

Please avoid cancellations and requests to switch dates if at all possible as it has a major impact on scheduling, however sometimes changes are unavoidable.

If you do need to cancel a New England course, we can provide a refund minus a $95.00 processing fee up to TWENTY-ONE DAYS prior to the start date.Refunds can only be given within the twenty-one day window if the spot(s) is filled by someone you introduce or from our waiting list.

All costs associated with books (i.e. book, mailing, sales tax, etc.) are non-refundable once they have been shipped. 

Caribbean courses are refundable minus a $95.00 processing fee up until 8 weeks prior to the course start date when the final balance is paid.

We strongly recommend that you purchase trip insurance through a third-party to make sure you are covered for any eventuality!

No shows / missed days

If a student does not show or misses a day(s), BRSS will try to accommodate a catch-up day when space is available on a first come first serve basis, however, BRSS has no obligation to make special accommodations or to provide a refund. The student may request to be on a stand-by list for a certain date or call a few days prior to each course to check availability, but attendance cannot be guaranteed if the course fills.

We try to ensure that groups and families have the same boat/instructor for their scheduled courses if they. Individuals from a group who cancel will be rescheduled individually.

No Show/Missed Day(s) cannot be carried over into future seasons. The burden to re-schedule a missed class is solely on the student.

Classes run rain or shine so dress for the weather and always come to class!  The instructor may decide to re-schedule the on-water lessons within the course structure or cancel or reschedule the on-water part of a course at their sole discretion. Caribbean courses have no weather re-scheduling options.
